Mobility Bike & car accidents: Five things you should know

With the arrival of warm weather, it becomes easier to use your bike, whether for daily commuting or for leisure activities. If you have an accident with a car, what happens? Will the repairs to your bike be refunded? If you are injured, what support will you have? What actions should you take?

1. Good traffic practices for cyclists

One of the first things to remember, as a cyclist, is that from the moment you are on the road, you must obey the Highway Code just like any other vehicle. The Highway Code applies just as much to cyclists as to car drivers. 
Don't forget to:

  • Go out properly equipped: your bike should be equipped with a bell, brakes, front and rear lights and reflectors (Cyclistes – Sécurité Routière (securite-routiere.lu);
  • Wear a crash helmet: there is no legal obligation, but in the event of an accident it reduces the risk of head injury by 85%;
  • Do not listen to music while cycling;
  • Do not drink alcohol before setting out for a ride;
  • Keep to the right; and if you are travelling in a group, you should cycle in a line, one behind the other, especially in villages and towns. 
  • Use the paths reserved for bikes, if there are any.
  • When you bike with children:
    • On the road: place the children at the back of the line, so that if an oncoming car is driving too quickly they will be protected.
    • On a track, in a forest or in a green lane: place the children in front of you, so that you can react more quickly if there’s a fall.

2. Make a statement

If, as a cyclist, you have an accident with a car, whether you are responsible or not, the best thing to do is to report it, just as you would for an accident between cars.

Some guidelines for filling in your report: 

  • Make it clear that you were a cyclist; 
  • Correctly report the layout of the accident site;
  • Take photos of the accident site and the road signs;
  • Do not admit liability, this will be assessed by the insurer.

The accident must be reported to your insurer within five days.
 

3. What insurance covers damage to your bike?

Responsibility for the accident will have to be determined and, depending on this:

  • If your bike is damaged, repairs may be covered by the optional all-risk cover for leisure items in your Home policy. This insurance covers damage to bicycles and electric bikes, even away from your home, up to EUR 10,000 depending on the options selected and the values declared
  • Damage to the bike may also be covered by all-risk valuables insurance or by InsureMybike.
  •  As regards your car, please refer to the cover provided by your car insurance.

 

4. What insurance covers damage to your car?

In this case too, everything will depend on who is responsible for the accident:

  • For bikes, private third-party liability insurance cover (often included in the Home policy) applies and will cover any damage to the car.
  • For cars, it is the car insurance which applies and will cover the losses suffered.
5. What insurance covers cyclists in the event of injury?

This situation will also depend on who is responsible for the accident which will be assessed by the insurer depending on the different policies subscribed. It is then up to the insurers to pay out the cover depending on the losses incurred.

If the cyclist needs to be taken care of, the National Health Centre and any supplementary health insurance will cover the medical costs up to the limit of what has been insured. It is also possible to take out specific accident insurance, such as BSafe. If you’re involved in an accident on your journey to or from work, the costs may also be covered by accident insurance.
 

You’re a frequent bike rider, so don't forget to respect the Highway Code and take all the usual precautions. Also check what insurance covers you in the event of an accident.

In any case, if you are involved in an accident with a car, the first thing to do is to make as detailed a report as possible. In most cases, it will be the insurer who decides who is responsible and what the compensation will be.
